TN Visa for Canadian and Mexican Professionals

New York is one of the most dynamic professional markets in the world, attracting top talent in finance, technology, engineering, healthcare, science, and education. For Canadian and Mexican citizens, the TN visa offers one of the fastest and most efficient pathways to work legally in New York for a qualifying employer. Our New York immigration attorneys guide professionals and employers through every stage of the TN process, from evaluating eligibility to preparing airtight applications and responding to challenges at the border or with immigration authorities.

What Is the TN Visa?

The TN classification is a nonimmigrant work status created under the United States-Mexico-Canada Agreement (USMCA), the successor to NAFTA. It allows citizens of Canada and Mexico to work in the United States in certain designated professional occupations. Unlike many other employment-based visa categories, the TN visa has significant advantages:

  • No annual cap or lottery. TN status is available year-round without numerical limits.
  • Fast processing. Canadian citizens can often apply directly at a port of entry and receive a decision the same day.
  • Renewable indefinitely. TN status is granted in increments of up to three years and can be extended repeatedly, provided the applicant maintains nonimmigrant intent.
  • Lower cost. Filing fees are modest compared to other work visa categories.

Who Qualifies for TN Status?

To qualify for a TN visa, an applicant must satisfy several core requirements:

  1. Citizenship. The applicant must be a citizen of Canada or Mexico. Permanent residents of those countries do not qualify.
  2. A qualifying profession. The intended job must fall within one of the professions listed in the USMCA, such as engineer, accountant, computer systems analyst, scientist, management consultant, or registered nurse.
  3. Required credentials. The applicant must hold the specific degree, license, or experience required for that profession. Most categories require at least a bachelor's degree in a related field; some require professional licensure or a combination of education and experience.
  4. A U.S. job offer. The applicant must have a prearranged offer of employment from a U.S. employer. Self-employment is not permitted under TN status.
  5. Nonimmigrant intent. The applicant must intend to remain in the United States temporarily.

Common TN Professions in New York

New York's economy generates strong demand across many TN-eligible occupations. Some of the professions we most frequently handle for clients working in New York include:

ProfessionTypical Minimum Requirement
AccountantBachelor's degree or professional designation (e.g., CPA, CA, CGA, CMA)
Computer Systems AnalystBachelor's degree, or post-secondary diploma plus three years of experience
EngineerBachelor's degree or state/provincial license
Management ConsultantBachelor's degree or five years of relevant experience
Registered NurseState/provincial license (New York licensure for New York positions)
Scientist (various disciplines)Bachelor's degree in the relevant field
EconomistBachelor's degree
Graphic DesignerBachelor's degree, or post-secondary diploma plus three years of experience

Because the profession list is fixed, a critical part of our work is analyzing whether a client's actual job duties—not just the job title—fit squarely within a listed occupation. A mismatch between the position description and the USMCA category is one of the most common reasons TN applications are denied.

The Application Process: Canadians vs. Mexicans

Canadian Citizens

Canadian citizens are visa-exempt and may apply for TN status in two ways:

  • At a port of entry or preclearance location. A Canadian professional can present a complete application package—employer support letter, proof of credentials, proof of citizenship—directly to U.S. Customs and Border Protection and, if approved, begin working immediately.
  • By petition with USCIS. A U.S. employer may file Form I-129 on the applicant's behalf, which can be useful for changes of status, extensions, or when the applicant is already in the United States.

Mexican Citizens

Mexican citizens must obtain a TN visa stamp at a U.S. consulate before traveling. This involves submitting Form DS-160, attending a visa interview, and presenting the employer letter and supporting credentials. Once the visa is issued, the applicant may enter the United States and begin employment in New York.

What Your Application Package Should Include

Whether applying at the border, at a consulate, or through USCIS, a strong TN application typically includes:

  • A detailed employer support letter describing the position, duties, duration, salary, and the professional qualifications required;
  • Degrees, diplomas, transcripts, and credential evaluations for foreign degrees;
  • Professional licenses where required, including New York State licensure for regulated professions practiced in New York;
  • Proof of Canadian or Mexican citizenship;
  • Evidence of the employer's legitimate business operations; and
  • Documentation of relevant work experience where a category permits experience in lieu of, or in addition to, a degree.

Duration, Extensions, and Family Members

TN status is granted for up to three years at a time and can be extended in three-year increments with no formal limit on the number of renewals. Extensions may be filed with USCIS from within the United States, or the professional may reapply upon reentry. Because TN status requires nonimmigrant intent, long-term holders who wish to pursue permanent residence should plan carefully with counsel to avoid jeopardizing their status.

Spouses and unmarried children under 21 may accompany the TN professional in TD status. TD dependents may attend school in New York but are not authorized to work. Dependents need not be citizens of Canada or Mexico to qualify for TD status.

Common Challenges and How We Help

Although the TN process can be fast, it is far from automatic. We regularly assist clients facing issues such as:

  • Denials at the port of entry due to vague employer letters or duties that appear to fall outside the claimed profession;
  • Degree mismatches, where the applicant's field of study does not clearly align with the position;
  • Management consultant scrutiny, a category that adjudicators examine closely for signs of disguised staffing arrangements;
  • Licensing questions for professions regulated by New York State, such as nursing and engineering;
  • Status changes from student or other nonimmigrant categories to TN while remaining in the United States; and
  • Immigrant intent concerns for TN holders who are considering green card sponsorship.

A denial at the border can complicate future applications, so getting the application right the first time is essential. Our attorneys prepare comprehensive, well-documented packages designed to anticipate and answer an adjudicator's questions before they are asked.
